Semirara settles labor case with truck driver, avoids headaches at CA
Semirara Mining and Power Corporation has executed a compromise agreement with a truck driver to settle his case and avoid protracted proceedings before the Court of Appeals (CA).
In a recent disclosure with the Philippine Stock Exchange (PSE), Semirara said it struck the agreement with dump truck driver Jimmy Juntilla after the CA referred the case to court-annex mediation.
Juntilla’s petition before the CA concerned the National Labor Relations Commission’s (NLRC) May 25, 2017 decision to uphold the labor arbiter’s October 28, 2016 dismissal of his complaint.
The driver claimed to have been illegally dismissed, while Semirara argued his termination was for a valid cause.
The labor arbiter ruled that Semirara “satisfactorily discharge the burden in proving that the complaint Juntilla’s dismissal was for a valid just cause and that the rudimentary requirements of due process was duly observed and complied with in effecting his termination from employment.” #
