SC told to void CA TRO on suspension of ERC execs
The Supreme Court on Tuesday was asked to set aside a temporary restraining order issued last month by the Court of Appeals stopping the suspension of four commissioners of the Energy Regulatory Commission.
The Alyansa Para sa Bagong Pilipinas (ABP) said there is a need to nullify the 60-day injunction issued by
the CA 9th Division and stop its implementation since the appellate court committed grave abuse of discretion amounting to lack or excess of jurisdiction when it issued the order.
The petition named the appellate court as public respondent and commissioners Alfredo Non, Gloria Victoria Yap-Taruc, Josefina Patricia Asirit, and Geronimo Sta. Ana as private respondents.
The four ERC commissioners were earlier suspended by the Ombudsman due to an allegedly anomalous agreement on electricity supply by 38 companies, seven of which are connected to the Manila Electric Company.
The Ombudsman said the four are administratively liable for conduct prejudicial to the best interest of the service, simple misconduct and simple neglect of duty.
