Sa travel agency nagkasal: SC forfeits retired Samal judge’s benefit for solemnizing wedding outside court
The Supreme Court (SC) has forfeited the benefits of a retired Island Garden City of Samal Municipal Trial Court in Cities (MTCC) judge for solemnizing a rushed wedding outside his jurisdiction in May 2008.
In a recent 10-page en banc decision, the SC held retired Judge Virgilio Murcia guilty of grave misconduct and conduct prejudicial to the best interest of the service, with prejudice to his appointment in the government.
The SC rejected Murcia’s explanation that he only solemnized the wedding of Rosilanda Keuppers in the office of DLS Travel and Tours in Davao City out of pity because her German fiance was soon returning to his country.
Instead of diminishing his liability, this even “highlighted his dismissive and cavalier attitude towards express statutory requirements instituted to secure the solemnization of marriages from abuse,” read the decision penned by Associate Justice Lucas Bersamin.
The court noted it had already fined Murcia P40,000 in an August 2007 SC decision for signing on a marriage contract without having actually solemnized the marriage.
