Justice over force: Makati court returns management of Infinity Tower to previous operator
The Makati City Regional Trial Court (RTC) has returned the property management of Infinity Tower condominium to its previous operator, four years after its attempt to take control nearly turned violent.
In a recent 4-page decision, Branch 147 Judge Ronald Moreno granted the petition of Greenstone Serviced Residences Makati Inc., which questioned the legal authority of Optimax International Corp. and Quadrillon Property Management Inc. to operate the condominium located in the central business district.
The decision lifted the writ of preliminary injunction earlier issued in April 2013 in favor of Optimax and Quadrillon.
Moreno cited the November 2017 ruling of the Makati City Metropolitan Trial Court (MeTC) Branch 62 that found Optimax representative Joaquin Rodriguez, Jr., and his father Joaquin, Sr., guilty of falsifying the property management agreement.
The said verdict “now puts in doubt the authenticity of the property management agreement from which the writ of preliminary injunction was based,” Moreno ruled.
On April 24, 2013, Greenstone tried to regain control of the condominium’s operations by leading about a hundred people to try to enter the building. A shot was fired by the security that night.
