First of its kind: SC recognizes Pinoy’s divorce from foreigner
The Supreme Court of the Philippines sets another historical case for the country. According to reports. the SC finally passed judgment on a landmark case that tackled foreign divorce.
Abogados and aspirants were astounded by this great precedent for divorce in the Philippines. According to the case, if a foreign divorce secured by Filipino against a foreign spouse was granted, it will be considered as valid here in the Philippines.
The said report was received with mixed reactions with some claiming that this is not a landmark case. One netizen claimed that it was already settled back in 2010 with the Dacasin v. Dacasin case, where Acting Chief Justice Antonio Carpio was ponente.
However, law students like Corpus Juris are celebrating this newest step forward to be at par with other countries. They stated that it is a basic recognition that “not all marriages work out and that divorce is a mode to remedy that situation.”
This landmark ruling plus the divorce bill is finally moving us toward parity with other countries in recognizing that not all marriages work out and divorce is a mode to remedy that situation.
Any freshman law student could tell you that the old rule just didn’t make sense. https://t.co/0e26pbEDbN
