Kulang na lang mag-abogado! SC sacks Baguio clerk of court for leaking court order to litigant
The Supreme Court (SC) has dismissed a Baguio City clerk of court for rendering “improper services” and even leaking a draft order of a different court to a litigant.
In a recent 10-page en banc decision, the SC found Municipal Trial Court in Cities (MTCC) Branch 1 Clerk of Court Lourdes Caoili guilty of grave misconduct and conduct unbecoming of a court personnel. It also meted out a lifetime ban from government employment.
Investigation showed the court employee released the unsigned order dismissing the civil case for accounting of stocks and shares against Margarita Cecilia Rillera. The said case was actually heard by the Regional Trial Court (RTC) Branch 5.
Caoili also allegedly gave aide to Rillera by procuring her lawyers, securing a transcript of stenographic notes and giving case updates. In exchange, Caoili received a “monthly remuneration” and her daughter was hired by Rillera as a private secretary.
“Meddling in a case pending before a court where she was not assigned and in which she had no relevance whatsoever is suspicious. Worse, it was also established that she was receiving consideration and/or remuneration therefor,” read the decision.
“Without doubt, respondent’s actions damaged the integrity of the service, jeopardized the public’s faith in the impartiality of the courts29, and eroded the public’s respect for the institution,” it concluded.
