Cebu court keeps Rico’s Lechon closed
The Cebu City Regional Trial Court (RTC) has denied the plea of the operator of Rico’s Lechon for an injunction against the closure of its three branches.
In a recent order, Branch 7 Judge Stewart Ramon Himalaloan gave weight to the argument of Cebu City government regarding its refusal to issue a business permit to 3MRS Dionson Corporation.
The judge ruled Mayor Tomas Osmeña “did not act whimsically in the closure of the petitioner’s business establishment. He observed due process. The allusion of ill-motive pictured by the petitioner against Mayor Osmeña is not even ostensible.”
Rico’s Lechon filed its petition for mandamus to compel the city government to issue its permit after Osmeña claimed the restaurant had not been paying the correct taxes.
