Untouchable yan! CA: Alfredo Lim ain’t got power to fire UDM law college exec
The Court of Appeals (CA) has ruled the Manila city government has no power to dismiss the officer-in-charge of the Universidad de Manila (UDM) College of Law.
In a recent 13-page decision, the CA 4th Division affirmed the Civil Service Commission’s (CSC) December 2014 ruling which set aside then-Mayor Alfredo Lim’s April 2013 dismissal of Dr. Elena Cernias.
The CA rejected the city’s claim that Section 9 of the Revised Charter of the City of Manila granted the mayor control over the city’s various agencies.
The court said the city’s own council passed City Ordinance No. 8120, vesting jurisdiction over the city university upon its Board of Regents.
“We cannot petitioner to simply override the jurisdiction which it expressly conferred upon the UDM Board of Regents, in the absence of another legislation to that effect,” read the decision penned by Associate Justice Elihu Ybañez.
Cernias’ case arose from her alleged unauthorized collection of additional tuition fees and school dues in 2012.
