CA denies residents’ plea to ban mining in Zambales

The Court of Appeals (CA) has denied the appeal of the residents of Santa Cruz, Zambales, on its May 22 decision dismissing their plea for a permanent environmental protection order (PEPO) stopping mining operations in the province.

In a recent 5-page resolution, the CA Former Special 14th Division maintained former Environment Secretary Gina Lopez’s order to close down 5 mining companies in the province rendered the Concerned Citizens of Santa Cruz, Zambales’ (CCOSZ) petition moot and academic.

“A perusal of the motion for reconsideration reveals no new and meritorious arguments and yields mere rehashed arguments, which had already been exhaustively discussed and squarely passed upon by this Court in the Resolution sought to be considered,” read the decision penned by Associate Justice Renato Francisco.
