Madaya! CA affirms Lanao del Sur cop’s dismissal for pretending to take civil service exam
The Court of Appeals (CA) has affirmed the Civil Service Commission’s (CSC) dismissal of a Lanao del Sur policeman accused of pretending to take the civil service eligibility examinations.
In a recent 13-page decision, the CA 1st Division denied the appeal of Police Officer 3 (PO3) Nestor Enero, who was assigned at Kapatagan Municipal Police Station, on the CSC’s finding that he was guilty of serious dishonesty, falsification, grave misconduct and conduct prejudicial to the best interest of the service.
Enero was accused of asking another person to take his examinations for him, and for falsely representing in his Personal Data Sheet (PDS) that he took and passed the test.
Verification showed “significant discrepancies” between him and the person who took the exam as shown in the picture seat plan.
The CA disregarded Enero’s claim that he was not regarded due process and afforded impartiality, because CSC Regional VII Director Karin Litz Lerma did not inhibit from his case despite the prosecuting officer being her subordinate.
